Welcome to ShiftProxies. These Terms of Service ("Terms") govern your use of our website at shiftproxies.com, our dashboard at dashboard.shiftproxies.com, and our proxy services (collectively, the "Services").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

ShiftProxies is operated by Keno Coco, Am Taubenschlag 5, 41352 Korschenbroich, Germany.

2. Service Description

ShiftProxies provides:

• Residential Proxies: Rotating and sticky residential IP addresses from 195+ countries, billed per GB of bandwidth used
• ISP Proxies: Dedicated static datacenter IP addresses registered to ISPs, available in select locations with unlimited bandwidth

Our Services are designed for legitimate business purposes including web scraping, market research, ad verification, and other lawful activities.

3. Account Registration

To use our Services, you must:

• Create an account on our dashboard
• Provide accurate and complete registration information
• Be at least 18 years old or the age of majority in your jurisdiction
• Maintain the security of your account credentials

You are responsible for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account.

4. Acceptable Use Policy

You agree NOT to use our Services for:

• Any illegal activities or to facilitate illegal activities
• Hacking, unauthorized access, or intrusion into computer systems
• Distributing malware, viruses, or other harmful software
• Sending spam, phishing emails, or unsolicited communications
• Harassment, stalking, or threatening behavior
• Fraud, identity theft, or impersonation
• Circumventing security measures or access controls
• Violating intellectual property rights or copyrights
• Distributing illegal content (child exploitation material, terrorism-related content, etc.)
• Activities that violate the laws of Germany, the EU, or your jurisdiction

We reserve the right to suspend or terminate accounts that violate this Acceptable Use Policy without refund.

5. Pricing and Payment

5.1 Pricing

Current pricing is displayed on our website and dashboard. Prices are subject to change, but existing purchases will be honored at the price paid.

5.2 Payment Processing

All payments are processed securely through Stripe. We accept major credit cards (Visa, MasterCard, American Express). By making a purchase, you agree to Stripe's terms of service.

5.3 Residential Proxy Bandwidth

Residential proxy bandwidth is purchased in GB increments and never expires. Bandwidth is measured as total data transferred (upload + download) through our proxy servers.

5.4 ISP Proxies

ISP proxies are purchased for fixed durations (7, 30, 60, or 90 days). The duration begins immediately upon purchase. Unused time is not refundable.

6. Refund Policy

Due to the nature of our digital services, we generally do not offer refunds once services have been activated. However:

• If you experience technical issues preventing service use, contact our support team within 24 hours of purchase
• Refunds may be considered on a case-by-case basis at our discretion
• Accounts terminated for Acceptable Use Policy violations are not eligible for refunds

7. Service Availability

We strive to maintain 99.9% uptime for our premium services. However, we do not guarantee uninterrupted service. We are not liable for:

• Scheduled maintenance (we will provide reasonable notice when possible)
• Service interruptions due to factors beyond our control
• Third-party service failures
• Network issues or connectivity problems

8. Intellectual Property

All content on our website, including text, graphics, logos, and software, is the property of ShiftProxies or its licensors and is protected by intellectual property laws.

You may not copy, modify, distribute, or create derivative works from our content without our express written permission.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• Our Services are provided "as is" without warranties of any kind
• We are not liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability shall not exceed the amount you paid for the Services in the 12 months preceding the claim
• We are not responsible for how you use our Services or any consequences arising from such use

You are solely responsible for ensuring your use of our Services complies with all applicable laws and regulations.

10. Indemnification

You agree to indemnify and hold harmless ShiftProxies, its owner, and any affiliates from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of our Services
• Your violation of these Terms
• Your violation of any third-party rights
• Your violation of any applicable laws

11. Account Termination

By You: You may close your account at any time by contacting our support. Unused balances are generally not refundable.

By Us: We may suspend or terminate your account immediately, without prior notice, if:

• You violate these Terms or our Acceptable Use Policy
• We are required to do so by law
• We detect fraudulent or suspicious activity
• We discontinue our Services (with reasonable notice)

12. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the new Terms on our website and updating the "Last updated" date. Your continued use of our Services after changes constitute acceptance of the new Terms.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Federal Republic of Germany, without regard to conflict of law principles.

For consumers residing in the EU: You may also bring proceedings in the courts of your country of residence. You have the right to use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

We are not obligated to participate in dispute resolution proceedings before a consumer arbitration board.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
